Trump promised to be "Mr. Veto" if Democrats won Congress. They did, and their strongest check on Iran, Israel and Ukraine is the spending bills

Republicans keep both chambers until January 3rd, and the stopgap funding law expires on December 11th. A war vote that failed 49-50 in September now looks passable, but a veto stands unless two-thirds of each chamber overrides it.

Executive Summary

Democrats won the House and the Senate on November 3rd, and the fight over three foreign conflicts now moves to money. Hakeem Jeffries, the House Democratic leader, and Chuck Schumer, the Senate Democratic leader, take over when the new Congress is sworn in on January 3rd2. NBC News projects about 255 House seats and, at 3:19 a.m. Eastern, counted 54 Senate seats with three races uncalled3,4. President Trump keeps his veto. "I'll become Mr. Veto," he said before the vote, adding that he would probably make deals later5.

The votes will change faster than the policy. A resolution to end the Iran war failed in the Senate 49-50 on September 24th, and on the new numbers a majority looks within reach6,4. But Congress needs two-thirds of each chamber to override a veto, and when the Senate did pass a resolution in June, a White House official said it had "no significance"7,8. A sanctions law that passed the Senate 86-11 was waived within weeks of becoming law9,7. The tools that can bind him are spending bills, the annual defense bill, subpoenas and confirmations.

The next two months matter most for anyone with exposure to these conflicts. Republicans keep control until January 3rd, and WilmerHale, a law firm, said before the vote that losing both chambers would give them their strongest reason to act first10. Talks on Ukraine open in Abu Dhabi on November 10th, and the stopgap expires on December 11th11,1. John Bolton, a former national security adviser, expects Trump to decide his next steps on Iran only after the election12.

01The Result

Democrats hold both chambers from January 3rd, though the final count is still moving.

Republicans went into the election with a narrow House majority and a 53-47 advantage in the Senate, where two independents caucus with the Democrats13. NBC News now projects that Democrats will win about 255 House seats, which could be their largest majority in nearly two decades, and says the estimate could still move by a few seats3. By 3:19 a.m. Eastern on November 4th it had called 231 seats for Democrats and 144 for Republicans, and 29 of those Democratic seats were flips14.

In the Senate, NBC News showed 54 Democratic seats and 43 Republican seats at the same hour, with seven seats flipped and three races uncalled4. Those wins include states Trump carried, such as Texas and Kansas15. The Detroit News reported that Abdul El-Sayed beat Mike Rogers in Michigan, an open seat Democrats already held16.

Trump called in to Fox News early on Wednesday, congratulated Democrats and said he accepted the results, according to Forbes18. He also said he could work with them on "many things"19. Our brief on whether Trump would contest the House results tests through November 30th whether he calls them rigged or his side sues, so his statements so far are an early reading. Forecasters' calls on both chambers, Nate Silver's among them, are being checked on our calls ledger.

02What a Vote Can and Cannot Do

Two recent cases show that winning a vote does not bind this White House.

A majority can pass a resolution. Only two-thirds of each chamber can overcome a veto7.

Case one: the June war powers resolution. On June 23rd the Senate adopted an Iran war powers resolution 50-48, after the House had passed it8. ABC News called the vote symbolic. A White House official said it had "no significance" and that hostilities had ended with the April 7th ceasefire8. DW reports that the administration has ignored it27.

Case two: the Graham sanctions law. The Lindsey O. Graham Russia sanctions bill passed the Senate 86-11 on August 7th and the House 262-159 in September9,28. The Senate margin cleared two-thirds. The House margin did not. On October 16th Trump issued a broad waiver, days after the Treasury lifted limits on Russian diesel purchases7. Steptoe, a law firm, had noted that the law does not require waivers to be renewed every 180 days9. Congress passed a law with wide support from both parties, and the president still set its terms.

None of these numbers makes a veto-proof House. Each vote below fell short of two-thirds of those voting, and about 255 seats is short of two-thirds of a chamber of 43517. Democrats would need Republican votes for any override.

Votes or projected seats

Seats are the NBC News projection on November 4th3. Ukraine aid vote21, Iran vote29.

Must-pass bills work differently, because a veto stops the money with it. Lawmakers could put Ukraine measures in defense spending or the National Defense Authorization Act (NDAA), the must-pass defense bill7. They would then "dare Trump to veto it," said Daniel Hamilton of the Brookings Institution, a Washington research group7. "He is unlikely to do so, since the overall bill funds the Defense Department," he said7. NPR notes that Democrats must also work with Republicans on the 12 annual spending bills5.

03Iran

Democrats' first test on Iran comes on December 11th, before they take control.

The war began on February 28th, and a ceasefire took hold on April 7th2,8. It has not ended the conflict. Per Energy News, relaying The Wall Street Journal, US forces struck the Iranian island of Qeshm this week in what unnamed officials called limited, defensive action24. Brent crude stood at about $105.06 on Tuesday morning, against about $70 before the war24. The Congressional Budget Office put the cost at $38bn after six months, rising by $3bn a month29.

The September vote shows how close the Senate already was. Four Republicans joined, John Fetterman was the one Democrat against, and Angela Alsobrooks did not vote6. Two of those Republican votes, Susan Collins and Thom Tillis, leave in January, so the new majority does not simply add to the old total30,31. The House has already passed such a resolution, most recently 220-204 with seven Republicans29.

Right now, the mechanism that is in front of us will be to aggressively move war powers resolutions until we end this war in the best interest of the American people.
The Intercept, Oct 17th, 20262

Jeffries said that to CNN before the election, The Intercept reports2.

War powers votes are the path that has already produced a resolution the White House set aside. The stronger tool is a rider, a clause in a funding bill barring money for the war, and the stopgap law that expires on December 11th offers the first chance2,23. It also carries the risk of a government shutdown, and Democratic leaders have not said they would take that risk2. Before the election, Senator Chris Murphy suggested blocking the NDAA unless it carries "ironclad" limits on the war23. A House majority would also, in theory, give Democrats standing to sue over the president's war authority, per Newsweek23.

The money runs the other way too. The administration asked in June for nearly $70 billion in extra defense funding, partly for the war1. The Center for Strategic and International Studies (CSIS), a Washington research group, expects Congress not to take that up as a separate package1. Some Republicans want to use a smaller $60 billion budget package, known as reconciliation, which CSIS calls their last opportunity for such a bill if they lose a chamber1. WilmerHale says Republicans are also weighing a year-end increase in the debt limit, to deny Democrats that deadline in 202710. John Thune, the Senate majority leader until January, is one of the people who will decide how much of that moves5.

Mark Cancian, a CSIS senior adviser, told Newsweek that Trump has publicly threatened to renew the conflict and that the US is "putting the pieces in place"23. Tehran, meanwhile, offered on Monday to reopen the Strait of Hormuz within two days, on conditions that include lifted oil sanctions and an end to the US naval blockade24. Our alert on Tucker Carlson's nuclear strike claim covers the rhetoric around that risk.

04Israel

Senate votes to block arms for Israel have about doubled since 2024, and the process still favors the sale.

Fig. 4

September 2024 from Roll Call32. Responsible Statecraft counts 27 Democrats in July 2025, and Roll Call counts 23 on a similar vote that month32.

On Election Day, Trump told Fox News that the aid would be "cut off at the end of the year," under a deal he said he had made with Prime Minister Benjamin Netanyahu33. He did not say which funds he meant or how they would end33. Netanyahu's office declined to comment34. The US gives Israel $3.8 billion of military aid a year under a 10-year agreement that runs to 2028, and appropriating the money is the job of Congress35. Former US officials questioned whether the cut would happen, especially if the US resumes military operations against Iran35. Congress sets that money in spending bills, and Democrats will help write them from January 3rd.

On April 15th the Senate rejected two resolutions from Senator Bernie Sanders: 40-59 on bulldozers and 36-63 on 1,000-pound bombs32,20. Only seven Democrats opposed both, Schumer among them20. In the House, nearly half of Democrats voted this summer to cut off aid, which came to $3.8 billion in the most recent fiscal year, Reuters reports22.

Of 127 joint resolutions of disapproval filed since 1974, the kind Sanders used, only one has been enacted, according to the Congressional Research Service32. The Jerusalem Post reports that some progressive candidates have discussed a group called "The Bloc", but cautions that this "does not necessarily mean the next Congress will eliminate US security assistance"13.

Results from October 27th gave Netanyahu's bloc 53 seats, Gadi Eisenkot's opposition bloc 48 and Arab parties 19, with 61 needed25. The results go to President Herzog, who then consults party leaders before choosing who may try to form a government36. For now the US Congress has no settled Israeli government to press. The larger effect may come later: the Post expects pressure on the party's 2028 presidential candidates to grow13.

05Ukraine

Russia sanctions drew the widest votes of the three, and Ukraine sits low on the Democrats' list.

In June, the House passed a Meeks bill 226-195 after 218 members forced it past their leaders21. It offered more than $1 billion in aid and $8 billion in loans, and supporters said the Senate was unlikely to act without Trump's backing21. Reuters said in October that new aid "likely would pass with the two-thirds majorities" needed to beat a veto22.

The Kyiv Independent takes the opposite view, reporting that two-thirds is something Democrats are unlikely to reach7. James Lindsay of the Council on Foreign Relations, a US research group, says Congress has "a poor track record" on overturning vetoes, and that it "cannot compel" Trump to change his diplomacy with Russia7. Several Republicans who favored a tougher line on Moscow are leaving, including Mitch McConnell, Thom Tillis, Bill Cassidy, John Cornyn and Michael McCaul30. And the Kyiv Independent reports that Ukraine is "far from the top" of the party's 100-day plan7.

Talks open in Abu Dhabi on November 10th, with Putin aide Vladimir Medinsky leading for Moscow11. First Lady Melania Trump is also to bring both sides to the White House to discuss a local ceasefire in Kherson11. Our brief on those talks found partial deals far more common than a full ceasefire across its scenarios, and our alert on Exercise Koalicja covers Europe's preparations. Congress can press on supply too, but not quickly. The State Department announced approval of a possible sale of 500 Patriot missiles on October 30th, and Aurélien Colson of the ESSEC business school said "Congress cannot manufacture weapons"26.

The dated item to watch is Treasury General License 135, which authorizes Russian diesel transactions through April 7th, 202737. Senator Richard Blumenthal argues an earlier law bars that cargo anyway37. Meeks has a bipartisan bill against it22.

06The Rest of the Term

Democrats gain the power to investigate and to refuse, which will not stop Trump acting abroad.

Robert Garcia, expected to chair the House Oversight Committee, posted "LAWYER UP" after the result5. He says his panel will look at Trump's cryptocurrency ventures, which NBC News says have earned him more than $1 billion3. Senate control halts the steady confirmation of Trump's judges, and Cabinet nominees will need at least a handful of Democrats5. On impeachment, Jeffries says Democrats "haven't ruled anything in" or out3.

Trump remains president through January 20th, 202910. "Historically, most presidents in this situation have turned to foreign policy," Hamilton told the Kyiv Independent, and he expects Trump to be "even more outrageous" in some initiatives7. Oversight can raise the political cost of those moves through hearings and subpoenas, but it comes after the decision.

07The Other Reading

The strongest case against ours is that the election itself will push Trump toward a way out of the war.

Dania Arayssi of the New Lines Institute, a Washington research group, says the result "will definitely push the Trump administration to push for an exit strategy"30. On this reading the pressure works without any law. A president with low approval, oil above $100 and a hostile Congress wants a deal, and Vice President JD Vance has spoken of progress in talks5,24.

Part of this may prove right. Arayssi herself says Iran "will not be under pressure to offer any additional compromise" as a result, which could make a deal harder30. Shahin Modarres of ITSS Verona, a research group, argues Tehran is miscalculating if it expects Democrats to restrain the White House12. Alan Eyre of the Middle East Institute describes a "bipartisan consensus" on Iran12. Michael O'Hanlon of Brookings told DW, "I don't think Congress will have huge powers here," though he said Congress might stop a major escalation by refusing to fund it27. Our argument rests on that funding point.

08Vektora Assessment

Expect louder votes soon and binding limits later, if at all, and treat the period to January 3rd as the main risk.

Our position. The new Congress is likely to pass an Iran resolution and open investigations quickly. Binding limits will come, if they come, through funding bills, and most of those fights fall in 2027. Until January 3rd Republicans hold the chambers and have reasons to move first, and Trump faces no new legal limit.

Confidence: medium. The legal mechanics are well documented across our sources. The weak points are final seat counts and the voting records of new senators, which we have not checked one by one. Trump's choices on Iran are also open, and Bolton says even Trump may not know his final decision12. Several details on the Iran talks and the Qeshm strike rest on one outlet, Energy News, relaying other reporting24.

What would change our view. A rider barring Iran war funds in a law Trump signs. A veto override on any foreign policy measure. Republicans in numbers joining Democrats on the December bill. On the other side, a new US bombing campaign before January 3rd would show the transition period mattered more than the result.

09Client Implications

Plan around dates and funding bills rather than the headline result.

ReaderWhat to do
Private equity and venture capital firmsCheck defense and energy holdings against two cases: a funding fight in December, and a $60 billion reconciliation bill passing first. Treat oil above $100 as dependent on the war in any price assumption.
Family officesKeep Iran-linked energy exposure sized for a resumed conflict until January 3rd has passed. A Democratic Congress does not reduce that risk in the near term.
CorporatesPrepare for a possible shutdown after December 11th, and for investigations in 2027 if you hold federal contracts in the areas Democrats have named. Firms using Russian diesel licenses should plan for April 7th, 2027.
Law firmsAdvise on sanctions as written and as waived, since the Graham law and its waiver now point in different directions. Watch for House suits over war authority and oversight subpoenas.
10Forecast Watch

Our calls test whether the money tools are used, and whether they bind.

Confidence on the mechanism: high. The veto, the override rule and the funding calendar are documented. Confidence on the horizon: medium. The dates depend on leaders who have not stated their plans, and on a war that may change first.
